Seller Terms

Thanks so much for bringing your family's pre-loved treasures to a LILLE SKAT event. We've tried to keep these terms short and plain-English — they just cover the practical stuff: what we charge, what we ask of you, and when you'll get paid. If anything below isn't clear, just ask us, we're happy to explain.

The full terms below apply every time you book and use a stand at a LILLE SKAT event. By submitting a stand booking request and paying your Stand Fee, you're agreeing to these terms, nothing tricky, we promise — see clause 16 for how these terms are accepted.

1. Definitions and Interpretation

1.1  In these Seller Terms, unless the context requires otherwise, the following words have these meanings:

“ACL”  means the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth).

“Business Day”  means a day other than a Saturday, Sunday or public holiday in Victoria, Australia.

“Commission”  means 10% of the sale price of each Item sold, as set out in clause 8.

“Event”  means a LILLE SKAT pop-up market event at which Sellers may sell Items.

“Item” or “Items”  means any clothing, shoes or books brought by a Seller for sale at an Event in accordance with clause 5.

“LILLE SKAT”, “we”, “us” and “our”  means J.T HANSEN & M HANSEN trading as LILLE SKAT (ABN: 29 689 271 308).

“Payout”  means the amount payable to a Seller following an Event, being the total sale price of the Seller's sold Items less Commission.

“Seller”, “you” and “your”  means the individual named on a stand booking request who brings Items to sell at an Event.

“Stand”  means the space, rack and shelving allocated to a Seller at an Event.

“Stand Fee”  means the A$45 fee payable under clause 4.

“These Seller Terms” or “this Agreement”  means these LILLE SKAT Seller Terms as in force at the time of your booking, together with the Key Bits table above.

“Website”  means www.lilleskat.au.

1.2  Headings are for convenience only and don't affect interpretation. A reference to a clause is to a clause of these Seller Terms unless stated otherwise.

2. Who's Involved

2.1  These Seller Terms are between LILLE SKAT and you, the person named on the stand booking request (the “Seller”).

2.2  They apply every time you book a Stand at an Event, for as long as we're running them.

2.3  LILLE SKAT makes no representations as to whether GST applies to your sale of Items, or as to your individual GST, income tax or other tax obligations arising from selling with us. It's your responsibility to make your own enquiries, keep your own records, and seek independent tax advice if you're unsure of your obligations. Nothing in these Seller Terms is tax advice.

3. What We Do For You

3.1  You book a Stand and bring along your own pre-loved Items to sell. We provide the venue, spread the word about the Event, run the checkout, and handle the sale and payment for you. Think of us as your sales assistant for the day.

3.2  Your Items stay yours until they sell. We're not buying them from you, we're selling them on your behalf and passing on what you're owed, minus our Commission.

4. Booking & Stand Fee

4.1  Stands can only be booked through the stand booking request form on our Website (www.lilleskat.au), in accordance with our Website Terms and Conditions. We're not able to accept stand bookings by phone, email, social media or in person.

4.2  Stands are A$45 each (the Stand Fee), payable at the time of booking to secure your spot.

4.3  Stand Fees are non-refundable if you cancel within 7 days of the Event, except where LILLE SKAT cancels the Event (see clause 12).

4.4  Why both a Stand Fee and a Commission? The Stand Fee covers your spot at the venue, the space, the rack, hangers, price labels, and the foot traffic. The Commission covers everything that happens on the day: our team running the checkout, taking card payments (and the fees that come with that), and handling your Payout afterwards. Between the two, you get a fully-run sale without having to stand behind a table all day yourself.

5. What You Can Sell

5.1  We're currently accepting children's clothing, shoes and books for newborns to age 10. Items must be clean, complete, functional and in good condition — things that are still lovely to use, wear and pass on. Items from discount and value retailers are generally not suitable for LILLE SKAT. Battery-operated and electronic books are not accepted.

5.2  Books must also be free of small or loose parts (for example stick-on eyes, buttons, glitter, or other attachments) that could come loose and pose a choking hazard for young children.

5.3  We're starting with these categories for now, with plans to expand into toys, furniture, baby equipment and more as we grow, so please hold off bringing toys, car seats, cots, prams or other larger equipment for the time being.

5.4  The following are never accepted for sale: damaged or broken items, unsafe or recalled goods, and counterfeit items.

5.5  LILLE SKAT may decline to display any Item that doesn't meet these standards at drop-off, or remove it from sale at any time.

6. Your Stand & Pricing

6.1  Your Stand includes a clothing rack (116cm wide) plus two shelves for shoes, books and smaller items. As a guide, we'd suggest around 35–40 hanging clothing items so shoppers have room to browse comfortably, there's no minimum, so bring as much or as little as fits.

6.2  You set the sale price for each of your Items, you know them best. LILLE SKAT doesn't value or price your Items for you.

6.3  We provide hangers for your clothing, price labels, and colour-coded size markers so shoppers can find the right size at a glance. Please use the price labels to mark every Item with your Stand number, so sales can be tracked and paid out correctly.

7. Setting Up

7.1  You'll have one hour before the Event starts to bring your Items and set up your Stand exactly how you want it. We'll share the exact time and location closer to the Event.

7.2  Just a quick check-in when you arrive, we'll confirm your name and show you where to grab your hangers, labels and markers from our supply table. Stands are first-come, first-served, so you're free to choose whichever one suits you best. No paperwork needed, since you'll have already agreed to these terms when you booked (see clause 16).

7.3  Once your Stand is set up, a member of our team will do a quick, friendly check of your Items, it's not about catching anyone out, just about helping make sure everything meets our standards (clause 5), including checking books for batteries, electronic components, or loose small parts — before doors open.

7.4  You don't need to be there on the day of the Event itself, once your Stand is set up and checked, our team runs the checkout and handles the sale for you.

8. Sale of Items & Payment to You

8.1  LILLE SKAT collects payment from customers on your behalf. We deduct a Commission of 10% of the sale price of each Item sold; the remainder is your Payout.

8.2  We'll pay your Payout within 2 business days of the Event, using the payment method you agree with us at booking (currently bank transfer or PayID).

8.3  After the Event, we'll let you know the total amount your Items sold for, this is a final total, not an item-by-item breakdown.

8.4  We can't guarantee that your Items will sell, it depends on pricing, season and demand on the day.

9. Unsold Items

9.1  Unsold Items must be collected within 45 minutes of the Event closing. This is a firm deadline, it's what lets us pack down and hand the venue back on time.

9.2  If something's left behind past this window, we'll treat it as donated and pass it on to a local charity partner on your behalf, unless you've let us know in advance that you need a bit more time.

10. Faulty or Unsafe Items

10.1  If a customer notifies LILLE SKAT that one of your Items is faulty, unsafe, or not as described, we'll contact you and pass on the details of the customer's claim (see clause 5 of our Terms of Sale).

10.2  Where we reasonably determine (or you agree) that a remedy is owed to the customer under our Terms of Sale or the ACL, you must, within 3 Business Days of being notified:

(a)  repay to LILLE SKAT the amount of your Payout attributable to that Item, so that we can refund the customer; and

(b)  respond promptly to any reasonable request for information we need to resolve the customer's claim.

10.3  If you don't respond within 3 Business Days, or don't repay the amount owing under clause 10.2(a), LILLE SKAT may:

(a)  deduct the amount owing from any future Payout owed to you; and/or

(b)  recover the amount owing from you as a debt.

10.4  This clause doesn't limit any right LILLE SKAT or a customer has against you at law, including under the ACL, in relation to an Item you've sold that turns out to be faulty, unsafe, or not as described.

11. Looking After Your Things

11.1  You're confirming that the Items are yours to sell, and that they're safe and legal to sell, the usual stuff.

11.2  To the maximum extent permitted by law, LILLE SKAT is not liable for any loss, theft, damage or destruction of your Items at any time, whether before, during or after an Event, including where caused by our negligence. Nothing in this clause excludes, restricts or modifies any guarantee, right or remedy you have under the ACL, or any liability that cannot lawfully be excluded (for example, liability for death or personal injury caused by our negligence).

11.3  We hold public liability insurance for the Event itself. That covers the Event, not your personal belongings, so for pricier items, your own contents insurance is worth a thought.

11.4  If something goes missing from your Stand, please let our team know straight away. We take this seriously, we'll report incidents to police where appropriate, and cooperate with any investigation, including providing CCTV footage if the venue has it available.

11.5  If you're bringing anything higher-value, please let us know at drop-off so we can keep an extra eye on it. Since we're not liable for loss, theft or damage (see clause 11.2), it's worth taking extra care yourself with anything you'd be gutted to lose, or considering your own contents insurance for pricier pieces.

12. If an Event Doesn't Go Ahead

12.1  If we ever need to cancel an Event (say, a venue falls through or extreme weather), you can choose a full refund of your Stand Fee or credit it toward your next booking.

12.2  On rare occasions we may need to decline or cancel a booking, including on the day, if Items don't meet our standards or if someone's being unsafe or disruptive to other Sellers or customers.

13. Photos & Marketing

13.1  We often take photos or video at Events to share on social media or our Website, the fun, buzzy market atmosphere! If you'd rather not be in any shots, just have a quiet word with our team on the day.

14. Your Information

14.1  When you book a Stand, we collect your name and contact details, and bank or PayID details to pay you after the Event.

14.2  We only use this information to manage your booking, run the Event, and pay you what you're owed. We don't sell it or share it with anyone outside our team, other than what's needed to process your Payout (for example, our bank).

14.3  You can ask us at any time what we hold about you, or ask us to correct or delete it.

14.4  We delete your bank or PayID details within 30 days of the Event, once your Payout is complete. We also delete your name and contact details within this window, unless you've opted in to us keeping them for future contact (see clause 14.5). We may keep basic sales records for longer, as required for our own tax and accounting purposes.

14.5  When you book a Stand, we'll ask whether you're happy for us to keep your name and contact details on file afterwards, so we can let you know about future Events. This is entirely optional and separate from the rest of your booking, saying no doesn't affect your current booking in any way. If you opt in, we'll keep just your name and contact details (never your bank or PayID details) until you ask us to remove them. We'll only use them to reach out about upcoming LILLE SKAT events, not for anything else.

15. General

15.1  These Seller Terms are the entire agreement between you and LILLE SKAT for each Event you take part in.

15.2  LILLE SKAT may update these terms from time to time; the terms that apply are the ones in place at the time of your booking.

15.3  These Seller Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.

15.4  If any part of these Seller Terms is or becomes invalid or unenforceable, that part is to be read down, or severed if it can't be read down, without affecting the validity or enforceability of the rest of these Seller Terms.

16. Acceptance

16.1  By ticking the acknowledgement box when submitting your stand booking request, and by paying your Stand Fee, you acknowledge that you've read, understood and agree to be bound by these Seller Terms. This creates a binding agreement between you and LILLE SKAT on the basis of these Seller Terms.

16.2  If you book a Stand in person or by any other means we agree to in a particular case, we'll ask you to confirm your acceptance of these Seller Terms in writing (including by email) before your booking is confirmed.
